Terms of service

The agreement between you and Wanrak when you create, run or help with an event.

These terms are a legal agreement between you and the company that operates Wanrak ("Wanrak", "we", "us"). They apply when you use the studio, publish an event site or use any tool for the day. By creating an account or using Wanrak, you accept these terms, the privacy policy, the acceptable use policy and, for the personal data of your guests, the data processing agreement. If you do not accept them, do not use Wanrak. Guests who only open an invitation are covered by the guest privacy notice.

Who may use Wanrak

  • You must be at least 18 years old and able to enter into a binding contract.
  • If you use Wanrak for a company or other organization, you accept these terms on its behalf and confirm you have the authority to do so. "You" then means that organization too.
  • Wanrak is in a private beta. We may decide who gets an account and may end the beta at any time.
  • You may not use Wanrak if the law of your country or ours forbids it, including trade sanctions.

Your account

  • Keep your sign-in email and your devices secure, and turn on two-step sign-in. You are responsible for everything done through your account and the workspaces you own.
  • Tell us at once through the contact page if you think someone else has used your account.
  • The information you give us must be true and kept up to date.

The service

  • Wanrak provides software to create event sites, manage guests and replies, collect photos and messages, and run tools on the day. We are a technology provider only. We are not a party to your event or to any arrangement between you, your guests, your vendors or your team.
  • We may change, add or remove features, limits and plans. We will give reasonable notice of a change that takes away something important you rely on, unless the change is needed for security or by law.
  • Beta features and anything marked as a preview are offered for testing, may change or stop at any time and may contain errors.
  • Event days. Networks, phones, venues and online services can fail. Keep your own copy of what you cannot do without on the day, such as the guest list, the seating plan and the schedule. Downloads for this are on each event's Exports page. We are not responsible for losses caused by an interruption on the day of an event.

Your content and your guests' data

  • You keep ownership of what you and your guests add: text, images, guest lists, replies, photos and messages ("content").
  • You give us a worldwide, non-exclusive, royalty-free license to host, copy, process, adapt (for example resize or compress) and display content only as needed to provide, secure and improve Wanrak for you, for as long as it stays in Wanrak and the deletion periods afterwards. We do not use your content to advertise or sell anything, and we do not sell personal data.
  • For the personal data of your guests, your team and vendors, you are the controller (the person who decides why and how it is used) and we are your processor. You are responsible for having a lawful basis to collect it, for telling the people concerned (the event site shows our guest notice and your own consent text), for children's data, which you add with their parents' agreement, and for answering their requests. Our duties as processor are in the data processing agreement.
  • You confirm that you have every right and permission needed for the content you add, including the consent of people who appear in photos where the law requires it, and that it does not break the law or anyone's rights.
  • Guests upload photos and messages to your event. We do not check content before it is published, apart from the automatic checks you can turn on. You moderate your event, and you are responsible for what you choose to show.
  • We may remove or hold content, or limit an event, where we reasonably believe it breaks these terms or the law, puts people at risk, or where a court or authority requires it.

Gifts, payments between people and other services

  • An event site can show your own payment details or QR code for gifts. Money sent that way goes directly between guests and you. Wanrak never receives, holds or checks it, and is not responsible for mistakes, fraud, refunds or taxes related to it.
  • Links and embedded services on event sites (maps, calendars, videos, payment apps) belong to third parties. Their own terms apply, and we are not responsible for them.

Singles

If a host turns singles on, adult guests may choose to meet each other. We do not check anyone's identity, age, background or intentions. Guests take part at their own risk and should take normal care when meeting someone. We are not responsible for the conduct of any user, on or off Wanrak. Every profile can be blocked and reported.

Plans and payments

Paid plans are not on sale yet. When they are, the price, taxes, what each plan includes and the refund rules are shown before you pay, and these terms will be updated. Until then, any paid features we turn on for you are a free trial or a courtesy that we may end.

Our property

Wanrak, its software, design, templates and brand belong to us or our licensors. These terms give you a limited, personal, non-transferable right to use Wanrak while they apply; nothing else is licensed. Do not copy, resell, reverse engineer or build a competing product from Wanrak, except where the law allows it. If you send us ideas or feedback, we may use them freely and without any obligation to you.

Suspension and ending

  • You may stop using Wanrak and delete your events and your account at any time. A deleted event can be restored for 30 days and is then deleted for good, files included. Download anything you want to keep first.
  • We may suspend or end your access, or remove an event, if you break these terms, if your use puts guests, other users or Wanrak at risk, if the law requires it, or if we stop offering Wanrak. Where possible and lawful we tell you first, explain why and give you time to download your data.
  • The sections on content, gifts, singles, our property, disclaimers, liability, indemnity and law continue after these terms end.

Disclaimers

To the fullest extent the law allows, Wanrak is provided "as is" and "as available". We do not promise that it will be uninterrupted, error free or secure against every threat, that content will never be lost, or that it will meet your particular needs, and we disclaim all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement. Some countries do not allow these exclusions, so some of them may not apply to you.

Limitation of liability

  • To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, goodwill, data or content, or the cost of a replacement event, venue, supplier or service, however it arises.
  • To the fullest extent the law allows, our total liability for all claims about Wanrak or these terms is limited to the greater of the amounts you paid us for Wanrak in the 12 months before the claim and 100 US dollars (or the same in Thai baht).
  • Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, for fraud, or for gross negligence or willful misconduct, and nothing takes away rights you have as a consumer under the law of the country where you live.

Your responsibility to us

If you use Wanrak for a business or organization, you will defend and compensate us, our staff and our suppliers against claims, losses and costs (including reasonable legal fees) that arise from your content, your events, your handling of personal data or your breach of these terms or the law. If you are a consumer, this applies only as far as the law where you live allows.

Events beyond our control

We are not responsible for a delay or failure caused by events beyond our reasonable control, such as natural disasters, epidemics, war, unrest, power or network failures, failures of our hosting or other suppliers, attacks or acts of government.

Law and disputes

  • These terms are governed by the laws of Thailand, without regard to conflict of law rules, and the courts of Bangkok have jurisdiction.
  • If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring a claim in its courts.
  • Before going to court, please contact us so we can try to solve the problem. Claims must be brought within one year of the event that caused them, where the law allows such a limit.

Changes to these terms

We may update these terms. We post the new version here with its date. For a change that matters, we tell account holders by email or in the studio at least 30 days before it takes effect, unless it is needed sooner for security or by law. If you keep using Wanrak after it takes effect, you accept the new terms; if you do not agree, stop using Wanrak and delete your account.

General

  • These terms, with the policies they link to, are the whole agreement between you and us about Wanrak.
  • If a part of these terms cannot be enforced, the rest stays in force. If we do not enforce a right at once, we have not given it up.
  • You may not transfer these terms without our written consent. We may transfer them to a company that takes over Wanrak, and we will tell you.
  • These terms are written in English and Thai. If the versions differ, the English version applies, as far as the law allows.
  • Questions and notices: use the contact page.
